Terms of Service

These Terms cover use of the TGP website and public inquiry channels. Client work is handled separately through proposals and written agreements.

1. Acceptance of These Terms

By accessing or using the The Gideon Project website, including any pages, content, contact forms, or partner inquiry forms on the site (the "Site"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Site.

These Terms apply to Site visitors, prospective clients, partner applicants, and anyone else who uses the Site.

2. Who We Are and What These Terms Cover

The Gideon Project ("TGP", "we", "us", or "our") is an AI and software agency based in Aarhus, Denmark. The Site is intended for a worldwide audience.

These Terms govern use of the Site itself. They do not, by themselves, create a client relationship, partnership, employment relationship, or binding obligation for TGP to accept any project, inquiry, or application.

3. Separate Agreements for Client Work

Client projects, software development, hosting arrangements, consulting, automation work, integrations, and similar services are handled under separate proposals, statements of work, contracts, or other written agreements.

If you engage TGP for paid work and there is a separate written agreement in place, that agreement controls over these Terms to the extent of any conflict.

4. Permitted and Prohibited Use

You may use the Site only for lawful purposes and in a way that does not interfere with the Site, our infrastructure, our products, or other users.

  • attempt to disrupt, damage, probe, overload, or gain unauthorized access to the Site, our systems, or connected services
  • introduce malware, malicious code, spam, or abusive automated traffic
  • scrape, copy, or harvest Site content or data in a way that exceeds lawful and reasonable use
  • impersonate another person or submit false, misleading, or infringing information
  • use the Site in connection with unlawful, fraudulent, or abusive activity

5. Age and Legal Capacity

The Site is not directed specifically to children. If you are below the age at which you can lawfully agree to these Terms or consent to relevant data processing in your jurisdiction, you may use the Site or submit information to us only with the involvement and permission of a parent or legal guardian.

By using the Site, you represent that you have the legal capacity to do so or have obtained any permission required by applicable law.

6. Inquiries, Submitted Information, and Confidentiality

If you contact us or submit information through the Site, including through the contact form or partner application form, you agree that the information you provide is accurate to the best of your knowledge and that you have the right to provide it.

Unless we have expressly agreed otherwise in writing, such as through a signed non-disclosure agreement (NDA), information submitted through the Site is not considered confidential.

We may store and review inquiry information internally, including in internal dashboards, tools, and workflows used to manage communications, projects, and partnership discussions.

7. Site Data and Communications

When you use the Site, we may collect limited technical and communications data connected with Site operation and inquiries, such as IP-based connection data, browser or device information, pages visited, referrer information, and the details you submit to us.

You agree that we may contact you using the information you provide in connection with your inquiry, project request, or partnership application.

8. Intellectual Property in the Site

The Site, including its design, branding, text, graphics, logos, case study material, code, layout, and other content, is owned by or licensed to TGP and is protected by applicable intellectual property laws.

Except as expressly allowed by law or with our prior written permission, you may not copy, reproduce, republish, sell, license, distribute, modify, or create derivative works from the Site or its content.

9. Partners, External Links, and Third-Party Services

The partners described on the Site are independent third parties working with or alongside TGP in specific contexts. They are not employees of TGP, and TGP is not part of their businesses.

The Site may reference or link to third-party services, platforms, or providers, including providers used in connection with our business or client work. Those third-party services operate under their own terms and policies, and TGP is not responsible for their content, conduct, availability, or performance.

10. Project Acceptance, Refusal, and Availability

Nothing on the Site is a binding offer to provide services. TGP may decline or stop pursuing any inquiry, proposal, or project at its discretion, including where a project is not a fit, creates legal or operational risk, or otherwise does not align with our business.

Service descriptions on the Site are illustrative only and may change at any time.

11. Ownership of Deliverables and Portfolio Rights

Unless a separate written agreement expressly states otherwise, TGP retains ownership of deliverables, source code, frameworks, systems, materials, know-how, and related intellectual property created in connection with a project.

Any license, transfer, handover, or assignment of rights must be stated clearly in writing.

Unless otherwise agreed in writing or restricted by confidentiality obligations, TGP may reference, describe, and display completed or publicly released work in its portfolio, case studies, marketing materials, and business development materials.

12. Fees, Cancellations, and Refund Position

The Site does not currently process payments directly. Project fees, billing, payment schedules, hosting charges, and related commercial terms are handled off-site and under separate agreements.

Unless otherwise stated in a separate written agreement, if a client pauses, cancels, abandons, or materially delays a project after work has started, TGP may invoice for work already performed, committed time, reserved capacity, expenses, completed milestones, and, where development is substantially complete, up to the full agreed project amount.

Any refund or cancellation arrangement for project work is determined primarily by the applicable proposal or client agreement.

13. Disclaimer of Warranties

The Site is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, TGP disclaims all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of accuracy, merchantability, fitness for a particular purpose, non-infringement, availability, or security.

We do not guarantee that the Site will be uninterrupted, error-free, secure, or suitable for your specific needs. Content on the Site is for general informational purposes only.

This section applies to the Site itself and does not override any express warranty that may be set out in a separate written client agreement.

14. Limitation of Liability

To the fullest extent permitted by law, TGP will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, business, goodwill, data, or opportunity arising out of or related to your use of, or inability to use, the Site.

To the fullest extent permitted by law, TGP's total aggregate liability arising out of or relating to these Terms or the Site will not exceed DKK 1,000.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law. This section applies to Site-related use and does not replace liability terms expressly agreed in a separate written client contract.

15. Changes to the Site and These Terms

We may update, suspend, change, or discontinue any part of the Site at any time without notice.

We may also update these Terms from time to time. The updated version becomes effective when posted on the Site, unless a later date is stated. Your continued use of the Site after updated Terms are posted means you accept the revised Terms.

16. Governing Law

These Terms are governed by the laws of Denmark, without regard to conflict of law principles, except where mandatory law requires otherwise.
